You must be at least 18 years old or the age of majority in your jurisdiction to use our services. If you are under 18, you may only use our services with parental or guardian consent. By registering for an account, you represent and warrant that all information provided is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

CreativAI grants you a limited, non-exclusive, non-transferable license to use our platform for legitimate business and personal purposes. You may use our AI tools to generate content, automate workflows, and enhance productivity within the scope of your subscription plan. You agree to use our services in compliance with all applicable laws, regulations, and these terms.

You are strictly prohibited from engaging in the following activities:

• Using our services for illegal, harmful, or fraudulent purposes
• Attempting to reverse engineer, decompile, or hack our platform
• Uploading malicious code, viruses, or harmful content
• Infringing on intellectual property rights of others
• Creating fake accounts or impersonating others
• Sharing your account credentials with unauthorized persons
• Using automated systems to access our services without permission
• Generating content that violates laws or third-party rights
• Competing directly with our services using our platform
• Attempting to overwhelm our systems or disrupt service availability

Our services are offered on a subscription basis with various pricing tiers. Subscription fees are billed in advance and are non-refundable except as required by law. We reserve the right to change pricing with 30 days advance notice. Your subscription will automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting our support team.

CreativAI retains all rights, title, and interest in the platform, including all intellectual property rights. Content generated using our AI tools belongs to you, subject to these terms and applicable law. You grant us a limited license to use your content for service improvement and support purposes. We respect intellectual property rights and expect users to do the same. Any infringement claims should be reported to our legal team immediately.

You retain ownership of content you upload or create using our platform. By using our services, you grant CreativAI a worldwide, royalty-free license to process, store, and analyze your content for service provision. We implement industry-standard security measures to protect your data. You are responsible for ensuring you have necessary rights to any content you upload and that such content complies with our acceptable use policy.

We strive to maintain high service availability but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice. Planned maintenance will be announced in advance when possible. We may update our platform features, functionality, and these terms as needed to improve our services and comply with legal requirements.

To the maximum extent permitted by law, CreativAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claims related to these terms shall not exceed the amount paid by you for our services in the twelve months preceding the claim. This limitation applies regardless of the legal theory upon which the claim is based.

You agree to indemnify, defend, and hold harmless CreativAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any rights of another party. This indemnification obligation will survive termination of these terms and your use of our services.

Either party may terminate this agreement at any time. We may suspend or terminate your account immediately if you violate these terms or engage in prohibited activities. Upon termination, your right to use our services will cease immediately. We will provide reasonable access to retrieve your data following termination, subject to our data retention policies and legal requirements.

These terms are governed by the laws of the jurisdiction where CreativAI is incorporated, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services will be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.
